 A federal judge has dismissed a lawsuit against Instagram the most controversial changes in the terms of service announced last year that many feared property awarded photos of users sharing service popular photos.

In a ruling issued Friday, Judge William Alsup of the U.S. District Court for the Northern District of California ruled that Lucy Rodriguez Instagram could not continue for a number of procedural reasons, including the level of injury of the applicant and the State. Alsup also rejected the applicant's request for leave to file a second amended complaint.

A Facebook representative declined to comment on the decision.

The lawsuit, which was filed last December, accused of breach of contract of service and try to "seize the property rights of customers," after announcing a review of its terms of service that many feared given the perpetual rights Service Sales of user photos without payment or notification. After a reaction from users, Instagram has quickly reversed and announced changes in terms may revert to the version in force since the service was launched in 2010.

Instagram said that the new conditions of service shall come into force on January 19, and users can not withdraw, but could eliminate your bills before the due date. The application was opposed to this last point, saying that customers could cancel but in doing so, they lose the right to your photos.

In a motion to dismiss in February, Instagram argued that Lucy Funes - the original applicant in the case - she did not have the right to request, because it would have deleted your account before applying the new terms and continue using your Facebook account January 19 when there have been changes in terms of service. Lucy Rodriguez was replaced by the plaintiff in an amended statement in March.
